Terms of service

TERMS OF SERVICE

Overview

Welcome to Aisle & All.

The terms “we”, “us” and “our” refer to Aisle & All. We operate this website and online store, including the information, products and services made available through it.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy and Shipping & Delivery Policy, explain the terms that apply when you use our website or purchase from us.

Nothing in these Terms is intended to limit or exclude any rights you have under applicable consumer law.

By using our website or placing an order with us, you agree to these Terms.

1. About us

Aisle & All is an ecommerce business based in Ireland specialising in wedding accessories, personalised wedding products and curated wedding details.

Our legal business details and contact information are set out at the end of these Terms.

You can contact us at:

hello@aisleandall.com

2. Eligibility and information you provide

When placing an order, you must provide accurate, current and complete information, including your email address, delivery information and any personalisation details required for your chosen product.

You are responsible for checking that all information you provide is correct before submitting your order.

This is particularly important for personalised products containing names, dates, wording, photographs, QR destinations or other customer-supplied information.

If you discover an error after ordering, please contact us as soon as possible. We will try to help, but we cannot guarantee that changes can be made once production has begun.

3. Products and product descriptions

We make reasonable efforts to describe and display our products accurately.

Colours and appearance may vary slightly depending on screen settings, production methods, materials and natural variations in the product.

For handmade, printed, natural-material or made-to-order products, minor variations that are consistent with the product description and normal manufacturing tolerances may occur.

These provisions do not affect your statutory rights. Goods supplied to consumers must conform to the sales contract and meet the requirements of applicable consumer law.

4. Personalised and made-to-order products

Many Aisle & All products are personalised or produced specifically for each customer.

Personalisation may include names, dates, wording, artwork, colours, photographs, printed designs or other customer-selected information.

You are responsible for checking any information that you submit to us for personalisation.

Where we provide a proof for approval, production may not begin until you approve it.

Once production of a personalised or made-to-order item has begun, it may not be possible to amend or cancel the order.

The statutory cooling-off right that normally applies to many online purchases does not generally apply to goods made to a customer's specifications or clearly personalised. This does not affect your rights if the goods are faulty, damaged, incorrectly produced or otherwise fail to conform to the contract.

5. Orders and contract formation

When you place an order through our website, you are making an offer to purchase the relevant products.

You will normally receive an automated order acknowledgement. This confirms that we have received the order but does not necessarily mean that production has begun.

We may contact you if we need clarification regarding personalisation, artwork, delivery details, availability or another aspect of your order.

We may decline or cancel an order where there is a genuine reason to do so, including where:

  • a product is unavailable;

  • we cannot fulfil the requested personalisation;

  • there is an obvious pricing or listing error;

  • payment has not been authorised;

  • delivery to the requested location is not possible; or

  • fulfilling the order would be unlawful.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

6. Prices, VAT and payment

Prices displayed to consumers on our website are shown inclusive of VAT where VAT is applicable, unless clearly stated otherwise.

Delivery charges and any other applicable charges will be shown before you complete your purchase.

For deliveries outside the European Union, the recipient may be responsible for local import duties, taxes, customs charges or handling fees unless we expressly state that these have been included.

We reserve the right to change prices at any time, but a price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.

Payment must be successfully authorised before we process an order.

7. Shipping and delivery

Production and delivery times vary by product.

Personalised and made-to-order products require production time before dispatch.

Any delivery timeframe displayed on a product page or provided by us is an estimate unless we have expressly agreed otherwise.

Some Aisle & All orders are fulfilled by specialist production partners. Different products in the same order may therefore arrive in separate parcels.

Aisle & All remains responsible for the fulfilment of your order even where a specialist partner produces or dispatches the product.

For consumer sales, goods normally remain at our risk until you, or a person nominated by you, obtains physical possession of them, except where you independently arrange a carrier that we did not offer or propose.

Full delivery information is contained in our Shipping & Delivery Policy.

8. Wedding and event dates

We understand that many products are being purchased for a specific wedding or event.

Please order with sufficient time to allow for production, delivery and, where necessary, correction or replacement.

If delivery by a particular date is essential, you should make this clear before ordering.

Where we expressly agree in writing that delivery by a specified date is essential, that agreement forms part of your order.

9. Returns, cancellations and refunds

Returns and cancellations are governed by our Refund Policy and your statutory rights.

Eligible non-personalised products may qualify for our voluntary return policy as described there.

Personalised or made-to-order goods are generally excluded from change-of-mind cancellation rights once production has begun where permitted by law.

This does not affect your remedies if an item is faulty, damaged, incorrectly personalised, not as described or otherwise does not conform to the contract.

10. Faulty or damaged goods

If you receive a faulty, damaged or incorrect product, please contact us promptly at hello@aisleandall.com.

We may ask you to provide photographs of the product and its packaging so that we can assess the issue and arrange an appropriate remedy.

Depending on the circumstances and your statutory rights, this may include repair, replacement, price reduction or refund.

Nothing in these Terms restricts any statutory remedy available to you under Irish or applicable EU consumer law.

11. Third-party production and fulfilment partners

We use specialist third-party printers, manufacturers, fulfilment partners and delivery companies to produce and deliver some Aisle & All products.

We may provide these partners with the information reasonably necessary to fulfil your order, including your delivery information and product personalisation.

Their involvement does not change the fact that your purchase contract is with Aisle & All.

Where applicable, personal information is handled in accordance with our Privacy Policy.

12. Customer-supplied content and personalisation

If you provide us with wording, photographs, logos, illustrations, QR destinations or other content for use in a personalised product, you confirm that:

  • you have the right to provide and use that content;

  • its use does not infringe another person's intellectual property, privacy or other rights; and

  • it is not unlawful.

You grant us and our fulfilment partners a limited right to use that content solely as reasonably necessary to produce and fulfil your order.

We do not acquire ownership of your customer-supplied content.

13. Our intellectual property

Unless otherwise stated, content created by or for Aisle & All, including our branding, product designs, website content, graphics, photographs and written material, belongs to us or is licensed to us.

You may use the website for personal, non-commercial purposes.

You may not copy, reproduce, commercially exploit or distribute our proprietary content without permission, except where permitted by law.

14. Third-party links and services

Our website may contain links to or integrations with third-party services.

We are not responsible for the content or operation of third-party websites that are outside our control.

If you choose to use a third-party website or service, its own terms and privacy policy may apply.

15. Shopify

Aisle & All is powered by Shopify, which provides the ecommerce platform used to operate this store.

Sales made through our store are made between you and Aisle & All.

Shopify is not the seller of the Aisle & All products you purchase.

16. Privacy

Personal information collected through our website and store is handled in accordance with our Privacy Policy.

Because our ecommerce store is hosted by Shopify, Shopify also processes certain information in order to provide the ecommerce platform and associated services.

Please review our Privacy Policy for further information.

17. Reviews, feedback and submissions

If you submit a product review, testimonial, suggestion or other feedback to us, you confirm that the material is truthful, lawful and that you have the right to submit it.

You grant us a non-exclusive, worldwide, royalty-free right to use and reproduce feedback that you submit for legitimate business purposes, including displaying customer reviews and improving or promoting our products and services.

We will not use customer-supplied wedding photographs or other personal content for marketing unless we have an appropriate basis or permission to do so.

18. Errors and inaccuracies

Occasionally our website may contain a genuine error relating to a product description, price, availability, delivery charge, promotion or other information.

We may correct such errors.

If an error materially affects an order you have already placed, we will contact you and, where appropriate, offer you the opportunity to confirm the corrected order or receive a refund.

Nothing in this section allows us to avoid our obligations under applicable consumer law.

19. Acceptable use of the website

You must not knowingly use our website:

  • for an unlawful purpose;

  • to transmit malware or malicious code;

  • to interfere with the security or operation of the website;

  • to attempt unauthorised access to systems or data;

  • to infringe the rights of another person; or

  • to conduct fraudulent activity.

We may restrict access where reasonably necessary to protect the website, customers or our business.

20. Availability of the website

We aim to keep the website available and accurate, but we cannot guarantee uninterrupted access at all times.

The website may occasionally be unavailable for maintenance, technical reasons or circumstances outside our reasonable control.

This does not affect any existing order or statutory rights you have in relation to products purchased from us.

21. Liability and statutory rights

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms excludes or limits your statutory rights as a consumer.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control.

If you are purchasing as a consumer, these Terms do not restrict any remedy or legal right available to you under Irish or applicable EU consumer law.

22. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions will continue to apply.

23. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

24. Governing law

These Terms are governed by the laws of Ireland.

If you are a consumer resident elsewhere in the European Union, you may also benefit from mandatory consumer protections provided by the laws applicable in your country of residence.

Nothing in these Terms is intended to restrict any right you may have to bring proceedings in a court that has jurisdiction under applicable consumer law.

25. Changes to these Terms

We may update these Terms from time to time.

The version that applies to your purchase will normally be the version in force when your order is placed.

Any changes will not retrospectively remove or reduce rights that have already arisen under an existing consumer contract.

The latest version will be published on this website.
